Sample AI Disclosure Language for Federal Court Filings
A reference paragraph for the certifications section of a brief that discloses AI assistance without overcommitting to specifics. Adapt to your jurisdiction and matter.
Where to place the disclosure: the certifications section. Avoid burying disclosure in an exhibit. Avoid putting it in a footnote where opposing counsel can argue it was hidden.
Sample language: "Pursuant to Rule 11 and consistent with this Court's standing order on artificial intelligence, undersigned counsel certifies that AI tools were used during the preparation of this filing. The reasoning, citations, and final language reflect counsel's independent judgment. A verifiable record of AI consultation and human revision is retained for the duration of this matter and available on the Court's request."
Two practitioner notes RedInkAI recommends. First, name the underlying retained record (a RedInkAI Cognitive Audit Report, for instance) so the certification is concrete, not aspirational. Second, do not promise to produce the record absent a Court order. That preserves work-product protections while signaling readiness.
